Rules
1. Eligibility: Contest open to 18 and over U.S. legal residents.
2. Entering: Videos can be completely original or a remake/mash-up of EC commercials. They must be submitted as a video response on YouTube by August 9th. Videos with offensive or copyrighted materials will be disqualified.
3. Winner Selection: First round will be a combination of public voting and judging; 10 finalists will be picked by voting and 5 will be picked by judges. Voting period ends August 16. During second round judges will choose three winners from the 15 finalists.
4. Prizes:
ONE (1) GRAND PRIZE: $2000.00 Scholarship and $1,000.00 Cash
ONE (1) FIRST PRIZE: $1000.00 Scholarship and $500.00 Cash
ONE (1) SECOND PRIZE: Amazon Kindle valued at $360.00
5. Conditions: Video must not infringe on copyright or trademark rights. By submitting your video you are assigning rights to that video to Education Connection.

ONLINE VIDEO COMPETITION
OFFICIAL RULES
1. ELIGIBILITY:
Online Video Competition (”Contest”) is only open to legal residents of the United States, who are at least 18 years of age or older at time of entry. Void where prohibited or restricted by law. Employees of Education Connection, Inc., YouTube, and their respective parent companies, affiliates, subsidiaries, participating vendors and sponsors, promotion or advertising agencies, or any other company involved with the design, production, execution or distribution of the Contest (all of the above, together with Sponsor, collectively referred to as “Promotion Entities”), and the employee’s immediate family members (parent, child, sibling, and spouse), regardless of where they live, and the employee’s Household Members, are ineligible to enter. “Household Member” shall mean people who share the same residence at least three (3) months per year (whether related or not). All federal, state, and local laws and regulations apply.
2. HOW TO ENTER:
No purchase necessary. Contest begins at 12:01 AM Pacific Time (”PST”) on 06/22/09 and ends at 11:59 PM PST on 08/09/09 (”Contest Period”).
Entrants have the opportunity to produce and submit via YouTube only an original music video using their own original music and lyrics, using the music and/or lyrics of one the Sponsor’s commercial songs, or any combination of either. The winning videos will be selected by public voting and by a panel of qualified judges based on the criteria set forth below.
To enter: During the Contest Period, visit www.youtube.com/educationconnection, login to your existing YouTube account or create a YouTube Account, and post a video response. Creating an account is free. Follow the links and instructions to make your entry and submit your original music video using one of Sponsor’s Commercial songs as a starting point (the “Video Submission”). Entrant does not necessarily have to use the lyrics or music of the Sponsor’s Commercial songs. Original lyrics, musical compositions, documentaries, animations, dramatic compositions, monologues and montages are all accepted. Feel free to be creative as long as the submission meets the requirements below and elsewhere in these Official Rules.
o Video Submission Requirements:
I. Entrants must have an active YouTube account to enter. Your personal information is subject to the privacy policies posted on YouTube at http://www.youtube.com/t/privacy and at educationconnection.com at http://www.educationconnection.com/global/privacyPolicy.aspx.
II. Entrants can view Sponsor’s videos and listen to Sponsor’s songs at contest.educationconnection.com. Each Video Submission can either use the complete lyrics of one of Sponsor’s songs, a variation of said lyrics, or original lyrics written by the entrant. The entry can either be completely original music and lyrics, sponsor’s lyrics and original music, sponsor’s music and original lyrics, or sponsor’s music and lyrics.
III. Entrants must own all rights, including copyright and performance rights, to their Video Submission and any original composition or lyrics, and must hold all necessary releases concerning the contents of the Video Submission. If other persons are shown in the Video Submission, entrant may be required to provide signed releases from such persons or, if under 18 years old, from the parent or legal guardian of such persons. In consideration of entering the Video Submission in the Contest, each entrant irrevocably licenses these rights to the Promotion Entities, and winners irrevocably assign these rights to the Promotion Entities.
IV. Each Video Submission must comply with video requirements located at http://www.youtube.com/t/howto_makevideo
V. Each Video Submission must not exceed 1 minute in length.
VI. Each Video Submission must not exceed 50 MB in size.
VII. Each Video Submission must comply with the YouTube Terms of Service located at http://youtube.com/t/terms
VIII. During the submission process, each entrant will be required to click where indicated to confirm that such entrant agrees to be bound by these Official Rules.
IX. Any Video Submission that includes content that is indecent, obscene, offensive, not suitable for a general audience, outside the intent of the Contest, contains material for which licenses are required, or does not comply with the YouTube Terms of Service located at http://youtube.com/t/terms or these Official Rules as determined by Sponsor in its sole discretion will be disqualified from the Contest and may be removed from YouTube.
X. By entering, entrants represent and warrant that their Video Submissions are their own original creations and do not infringe any other person’s or entity’s rights, and that they and any other person appearing in their Video Submission release any and all claims concerning use, performance, modification and distribution of the Video Submission and their likenesses, statements or performances.
Each entrant may submit one (1) entry only during the Contest Period. No joint submissions. One (1) entrant per YouTube account and per email address. In the event of any dispute concerning the identity of the entrant, the entry will be deemed made by the authorized account holder for the applicable internet service. Any attempt by any entrant to submit more than one (1) entry by using multiple/different accounts or email addresses, identities, registrations, or any other methods may void and disqualify all submissions entered by that entrant, at the sole discretion of Sponsor. Entries (including Video Submissions) will be screened for eligibility and compliance with requirements; incomplete, ineligible or non-complying entries will be disqualified. The Promotion Entities are not responsible for late, lost, stolen, misdirected, incomplete, invalid, unintelligible, or misdirected entries, which are void. Sponsor will not acknowledge receipt of entries.
3. SELECTION OF WINNERS:
a. Round 1: Once a video submission has been posted as a video response on http://www.youtube.com/EducationConnection, all or fewer than all Video Submissions may be posted on contest.educationconnection.com for public voting. All submissions must be made by 11:59 PM PST on 08/09/09. The video submissions may be posted on the http://www.youtube.com/EducationConnection web site and possibly other web sites to be determined at the sole discretion of Sponsor.
Entrant will be notified when their video submission is posted on contest.educationconnection.com. Anyone can vote once a day on a video submission via the blog posts at contest.educationconnection.com. 10 finalists with the most votes will be selected and presented to the panel of qualified ECS judges for round two judging. Each video submission will also be evaluated by a panel of qualified ECS judges and 5 additional finalists will be selected using the judging criteria set forth below. The voting period ends 11:59 p.m. PST August 16, 2009. The first round of judging is to conclude no later than 8/17/2009.
b. Round Two: The panel of qualified ECS Judges will evaluate the 15 Video Submission finalists selected as described above based on the following Judging Criteria: Content Related to Sponsor (40%), Creativity (40%) and Suitability for Promotional Use (20%). Final judging will be conducted on or about 08/21/09. The decisions of the judges are final. In the event of a tie, Video Submissions with the highest points in the content as Related to Sponsor category will win; if there is another tie, Video Submissions with the highest points in the Creativity category will win.
4. PRIZES:
- ONE (1) GRAND PRIZE: $2000.00 Scholarship and $1,000.00 Cash
- ONE (1) FIRST PRIZE: $1000.00 Scholarship and $500.00 Cash
- ONE (1) SECOND PRIZE: Amazon Kindle valued at $360.00
Prizes are non-transferable. No substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute any listed prize or prize component for one of equal or greater value if a designated prize or component should become unavailable for any reason. Approximate Retail Value of all prizes: $4,800.00.
Potential winners will be notified by email and must respond within three (3) days by phone or email, or will be disqualified and Sponsor may select an alternate winner in the same manner. Potential winners may be required to sign and return an Affidavit of Eligibility, Liability Release, Publicity Release and Assignment of Rights within twenty-one (21) days of the initial notification date or potential winner will be disqualified and Sponsor may select alternate winners in the same manner.
Scholarships will be awarded in the form of a check payable to an accredited university, college (regular, junior or community) or trade school at which the winner is enrolled as a full-time student. Should a winner not yet be enrolled in any school at the time of prize notification, the scholarship will be available for up to two (2) years from date of prize notification; and if not used after such time, the award will be forfeited. Scholarship payment will be applied to tuition; and any balance remaining may be used for other valid school charges. In the event a winner leaves a school and is entitled to a cash refund for all or any part of the scholarship payment, at sole discretion of Sponsor, refund payment shall be made to Sponsor or to an eligible school to which winner has transferred. Cash will be awarded in the form of a visa or mastercard debit card.
All prizes, excluding scholarships, will be sent to the winner via certified overnight mail. Prizes cannot be used or redeemed in conjunction with any other promotion or offer. No substitutions or transfer of prizes permitted. If any winner is unable to accept a prize for any reason whatsoever, or if any prize or prize notification is returned as undeliverable, that potential winner may be disqualified and Sponsor may select an alternate winner from the remaining pool of eligible entries in the same manner. Taxes and any other expenses and incidentals not mentioned herein are each winner’s sole responsibility. Sponsor may require winners to provide Social Security numbers for tax reporting purposes. By entering, entrants agree to abide by and be bound by these Official Rules.
5. CONDITIONS:
By participating and/or submitting an entry or accepting any prize, you represent and warrant that your Video Submission (a) does not violate or infringe any copyright, trademark or other proprietary, contractual, privacy or publicity right of any person or entity, and its use in any manner by Sponsor and its affiliates and agents will not incur any obligation to pay any party and (b) the footage being submitted is real and accurate. You hereby irrevocably license all such rights to the Promotion Entities in all media throughout the world in perpetuity. Each winner assigns his/her Video Submission, and all words, images, concepts or ideas contained or embodied therein, to Sponsor which become the sole property of Sponsor. Sponsor reserves the right to edit the content of each Video Submission as it sees fit and to identify you as the source of your submission.
By submitting the Video Submissions and licensing or assigning your rights, entrants grant Sponsor and its affiliates and agents permission to use the Video Submissions for any purpose and in any media whatsoever, worldwide, without further compensation to entrants. Selected videos may be posted on Sponsor’s and/or YouTube’s website at any time, if deemed appropriate by Sponsor and at Sponsor’s sole discretion. Acceptance of any prize constitutes consent to use of winner’s name, likeness, statements, and biographical data for advertising/publicity purposes in any medium without additional compensation, except where prohibited by law. Entrants hereby release and hold harmless each of the Promotion Entities and their officers, directors, employees, agents, and representatives from any and all claims, demands, losses and liabilities arising out of this Contest, or use, performance, modification and distribution of the Video Submission or any likeness, statement or performance, or use or misuse of the prize awarded hereunder.
Sponsor assumes no liability or responsibility for damages, losses or injury resulting from this Contest or the acceptance or use of any prize. All entrants further agree that in the event of any third party claims, damages, losses or injuries or death arising from or relating to this Contest, or any use, performance, modification and distribution of the Video Submission or any likeness, statement or performance, or the winner’s use of any prize, entrant will indemnify and hold harmless each of the Promotion Entities and their officers, directors, employees, agents, and representatives from any and all such claims, including the attorneys’ fees related thereto. Entrant is responsible for all on-line charges incurred with any Internet service provider and/or wireless carrier.
Sponsor is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures or any telephone network, computer equipment, software, inability to access any Website or on-line service, or any other error or malfunction, or late, lost, incomplete, illegible or misdirected entries. No mechanical reproduction of entries accepted. Mass entries, or entries generated by a script, macro or use of automated devices will be disqualified. Entry materials that have been tampered with or altered are void. If the judges determine, in their sole discretion, that there is any suspected or actual tampering with the Contest or if technical difficulties compromise the integrity of the Contest, the judges reserve the right to void the entries at issue and/or terminate or modify the Contest using all eligible entries received as of the termination date.
If the Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at contest.educationconnection.com and www.youtube.com/EducationConnection. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action. All decisions of Sponsor are final and binding.
6. WINNER’S LIST:
For a copy of these Official Rules or a list of the winners, send a separate, self-addressed, stamped envelope to: “COMMERCIALS VIDEO Winners List”, 3020 N Military Trail, Ste 275, Boca Raton, FL 33431 by 09/15/09. Specify whether you would like a copy of these Official Rules or the winners’ list. Winners will also be posted on contest.educationconnection.com on or about 08/31/09 or when all winners have been verified and confirmed.
